Terms of Service for North Valley Water Solutions covering website use, orders, installations, subscriptions, warranties, and water-quality disclaimers.

1) Acceptance of These Terms
By accessing our website, scheduling a service, purchasing equipment, or using any related apps, customer portals, or monitoring devices (collectively, the “Services”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Services. If you are entering into these Terms on behalf of a company or property owner, you represent that you have authority to bind that entity.

2) Who We Are & What We Do
North Valley Water Solutions (“North Valley,” “we,” “us,” “our”) provides residential and commercial water solutions, including assessment/testing, system design, equipment sales, installation, maintenance, filter-subscription programs, and optional remote monitoring. We are not a public utility and do not guarantee uninterrupted water supply.

3) Eligibility; Accounts
You must be at least 18 and able to form a binding contract. Certain features may require an account. Keep credentials confidential and notify us of suspected unauthorized use. We may refuse or terminate accounts for misuse or nonpayment.

4) Quotes, Orders, Pricing & Taxes
Quotes/Proposals. Written quotes are valid for the time stated on the document; otherwise 30 days.
Orders. We may accept, reject, or limit orders. Availability is not guaranteed until confirmed.
Pricing. Prices may change without notice until your order is accepted. Applicable taxes, permits, and disposal fees are your responsibility unless stated otherwise.
Billing. You authorize us to charge your on-file payment method for one-time purchases and any recurring programs you opt into.

5) Shipping, Delivery & Risk of Loss
For equipment shipped to you, title and risk of loss pass upon delivery to the carrier. Inspect packages upon arrival and promptly report damage (usually within 48 hours).

6) Site Access, Installation & Permits
Access. You must provide safe access to the property (including crawlspaces, mechanical rooms, shutoff valves, electrical panels).
Pre-existing Conditions. We are not responsible for failures caused by existing plumbing, pressure problems, code violations, corrosion, scale, sediment, or hazardous materials (e.g., asbestos, lead).
Permits/Code. You are responsible for permits unless our written proposal states otherwise. We install per applicable codes based on conditions observed.
Water Pressure/Flow. System performance depends on source water quality, temperature, pressure, and flow. You are responsible for maintaining adequate pressure/flow.

7) Water Testing & Quality Disclaimers
Screening vs. Certified Testing. On-site tests are screening tools and not a substitute for a certified laboratory analysis. Where regulatory compliance is required, you must obtain certified lab results.
No Absolute Guarantee. Water chemistry varies over time. We do not warrant permanent removal of any specific contaminant unless expressly stated in a written performance guarantee.
Source Changes. Well remediation, municipal treatment changes, seasonal runoff, construction, or plumbing work can affect water quality and system performance.

8) Maintenance, Filters & Subscriptions
Required Maintenance. Filters, membranes, resins, UV lamps, and other components require periodic replacement. Follow the service schedule provided.
Subscriptions. If you enroll in an auto-ship or maintenance plan, it will renew continuously until canceled. You can cancel at least [10] days before the next renewal via your portal or by contacting us at [Support Email/Phone].
Neglect. Failure to perform maintenance may cause leaks, damage, or loss of performance and void warranties.

9) Smart Devices & Monitoring
If you use connected meters, leak sensors, or controllers:
Data. Devices may collect usage, flow, pressure, and diagnostic data. We use this to operate and improve the Services. See our Privacy Policy.
No Emergency Service. Monitoring is not a life-safety or emergency response system. Call 911 for emergencies.

10) Returns, Cancellations & Restocking
Stock Equipment (Uninstalled). Eligible unopened items may be returned within [30] days, subject to a [15%] restocking fee.
Custom/Installed Items. Custom-built, special-order, or installed equipment is non-returnable unless defective per warranty.
Scheduling. Cancellations within [24–48] hours of an appointment may incur a service fee. (Your rights may vary by state.)

11) Warranties
Manufacturer Warranties. Equipment is covered by the manufacturer’s written warranty (if any). We pass through those warranties to you.
Workmanship Warranty. We warrant our installation workmanship for [12] months from completion, excluding misuse, alterations, neglect, or acts beyond our control.
Disclaimer. EXCEPT AS EXPRESSLY STATED, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT OTHER WARRANTIES, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT).

12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOSS OF USE, OR WATER DAMAGE FROM LEAKS) EVEN IF ADVISED OF THE POSSIBILITY; AND (B) OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT. Some jurisdictions do not allow certain limitations; your rights may vary.

13) Customer Responsibilities & Indemnity
You are responsible for: (i) truthful information about your property and water source; (ii) protecting equipment from freezing, flooding, and pests; (iii) timely maintenance and filter changes; and (iv) compliance with local codes. You agree to indemnify and hold us harmless from claims arising out of your misuse, negligence, or breach of these Terms.

14) Prohibited Uses (Website/App)
You may not: (i) reverse-engineer or scrape our site/app; (ii) attempt to bypass security; (iii) use the Services to violate law; (iv) infringe IP rights; or (v) introduce malware.

15) Intellectual Property
All content on our site/app—including text, graphics, logos, photos, and software—is owned by or licensed to North Valley and protected by IP laws. You receive a limited, revocable license to access and use the site for its intended purpose.

16) Communications; SMS/Email Consent
By providing contact information, you consent to receive service, account, and marketing communications via email, phone, and SMS/MMS. Message/data rates may apply. You can opt out of marketing messages at any time (reply STOP). Transactional or critical service messages may still be sent.

17) Privacy
Our collection and use of personal information is described in our Privacy Policy, incorporated by reference.

18) Suspension & Termination
We may suspend or terminate access for violations of these Terms, fraud, nonpayment, or to protect the security of the Services. You may cancel your account at any time.

19) Changes to Terms
We may update these Terms from time to time. Changes take effect on posting the “Last updated” date above. Material changes will be highlighted on the site.

20) Dispute Resolution; Governing Law
These Terms are governed by the laws of the State of [State], without regard to conflict-of-law rules. Before filing a claim, the parties will attempt good-faith resolution within 30 days after written notice. If you are a consumer, you may also have rights to bring claims in small-claims court. Any claim not eligible for small-claims court will be brought in the state or federal courts located in [County, State], and the parties consent to personal jurisdiction there. 21) Entire Agreement; Severability
These Terms (plus any signed proposal/work order and our Privacy Policy) are the entire agreement. If any provision is unenforceable, the remainder stays in effect.
