These Terms & Conditions (“Terms”) govern the sale, installation, and service of water treatment equipment and related products by North Valley Water Solutions (“North Valley,” “we,” “us,” or “our”) to you (“Customer” or “you”). By accepting a quote, signing an agreement, scheduling an installation, or making a payment, you agree to these Terms.

1. Quotes, Estimates & Pricing

Quotes and estimates are valid for the period stated on the document (30 days unless noted otherwise) and are based on the information available at the time, including the condition of your existing plumbing and the results of any water test. Prices are in U.S. dollars and exclude applicable sales tax unless stated. We reserve the right to revise a quote if site conditions, water-test results, or product availability differ materially from what was assumed when the quote was prepared. A quote is an offer, not a binding contract, until accepted by both parties.

2. Payment Terms

Unless otherwise agreed in writing, a deposit may be required to schedule installation, with the balance due upon completion of the installation. We accept the payment methods identified at the time of sale. Past-due balances may accrue interest at the maximum rate permitted by California law and may be referred for collection, with the Customer responsible for reasonable collection and legal costs. Title to equipment passes to the Customer only upon receipt of payment in full.

3. Scheduling & Installation

Installation dates are estimates and may shift due to weather, supply, permitting, or scheduling factors. We perform installations with our own team. The Customer is responsible for providing safe, clear, and lawful access to the installation area, including adequate space, drainage, and electrical and plumbing connections that meet applicable code. If additional work is required to complete a safe, code-compliant installation (for example, repairs to pre-existing plumbing, drainage, or electrical deficiencies), we will notify you, and any such work may be quoted separately.

Where required, the Customer is responsible for any permits and homeowner-association or landlord approvals unless we have agreed in writing to obtain them on your behalf.

4. Customer Responsibilities & Site Conditions

You represent that you own the property or are authorized to approve the installation, and that you have disclosed known issues with the water supply, plumbing, or electrical systems. We are not responsible for damage arising from pre-existing conditions, undisclosed defects, concealed plumbing, or non-conforming prior work. We are not responsible for the cosmetic restoration of walls, flooring, landscaping, or finishes disturbed in the normal course of a professional installation.

5. Limited Warranty

North Valley provides a limited warranty on systems we install, covering defects in covered parts and our installation workmanship for the period stated on your sales documents (up to ten (10) years on qualifying systems). This warranty covers repair or replacement, at our discretion, of covered components that fail under normal residential use. Manufacturer warranties, where applicable, are passed through to the Customer.

This limited warranty is the only warranty we provide. To the fullest extent permitted by law, all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, are disclaimed.

6. Warranty Exclusions

The limited warranty does not cover, and we are not responsible for:

  • Consumable and routine-maintenance items, including filters, cartridges, membranes, and softener salt.
  • Damage from misuse, accident, freezing, fire, flooding, power or water-pressure irregularities, acts of nature, or failure to perform required maintenance.
  • Equipment that has been modified, relocated, repaired, or serviced by anyone other than North Valley, or that has had serial numbers removed or altered.
  • Issues caused by changes in the incoming water supply or municipal water quality.

Warranty service requires that your account be in good standing and that you contact us and allow us a reasonable opportunity to inspect and address the issue.

7. Water Quality Disclaimer

Water treatment systems are designed to reduce certain contaminants and improve water characteristics such as hardness, taste, and odor. They do not “remove” all contaminants, and we make no representation that treated water is suitable for any particular purpose or meets any specific health standard. Treatment performance varies with the source water, usage, and maintenance. Nothing we provide is medical advice, and our products are not represented as treating or preventing any health condition. Where water is from a private well or is otherwise not from a regulated public supply, the Customer is responsible for any testing required to confirm the water is safe for its intended use.

8. Maintenance, Filters & Salt

Proper performance depends on routine maintenance, including timely filter and cartridge replacement and, for softeners, maintaining adequate salt. Maintenance and consumables are the Customer’s responsibility unless covered by a separate written service agreement. Failure to maintain the system as recommended may reduce performance and may void applicable warranty coverage.

9. Cancellations & Refunds

You may have a right to cancel certain home-solicitation sales within the period required by California law; any such right will be disclosed in your sales documents. After installation has begun or custom or special-order items have been procured, cancellations may be subject to charges for work performed, equipment, and restocking. Refunds, where applicable, are issued to the original payment method.

10. Limitation of Liability

To the fullest extent permitted by law, North Valley’s total liability arising out of or relating to the products, installation, or these Terms will not exceed the amount you actually paid for the product or service giving rise to the claim. North Valley will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of use, property damage, or water damage, even if advised of the possibility of such damages. Some limitations may not apply where prohibited by law.

11. Indemnification

You agree to indemnify and hold North Valley harmless from claims arising out of your breach of these Terms, your misuse of the equipment, or conditions at the property that were not disclosed to us, except to the extent caused by our negligence or willful misconduct.

12. Text Message (SMS) Communications

By providing your phone number, you consent to receive calls and text messages from North Valley about your inquiry, quote, appointment, order, and service, including via automated technology. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time or HELP for help. We do not sell your information; see our privacy practices for details. Opting out of texts will not affect warranty coverage.

13. Product Availability & Changes

Product specifications, models, and components may change without notice; we may substitute components of equal or greater quality. We reserve the right to correct errors in pricing or descriptions.

14. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing any claim, the parties agree to first attempt to resolve the dispute informally by contacting each other. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Sacramento County, California, and the parties consent to that venue and jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of your purchase governs that transaction. Continued use of our products or services after an update constitutes acceptance of the revised Terms.
